Official title: Amended Act of 2 August 2002 concerning the protection of individuals with regard to the processing of personal data.The Act of 2 August 2002 came into force on 1 December 2002 and has been amended by the Act of 27 July 2007 and the Act of 28 July 2011. It transposes the provisions contained in Directive 95/46/EC of the European Parliament and the Council of 24 October 1995 into national legislation. This Act repeals the previous amended Act of 31 March 1979 regulating the use of individual data in computerised processing (see section below entitled "legislative texts no longer in force"). Note: The provisions concerning surveillance at the workplace by the employer (which could previously be found in article 11 of the Act) can be found in article L.261-1 (1) of the Employment Code since 2007.
Official title: Amended Act of 30 May 2005 concerning the specific provisions for protection of the individual in respect of the processing of personal data in the electronic communications sector, and amending Articles 88-2 and 88-4 of the Code of Criminal Procedure.The Act of 30 May 2005, amended by the Act of 27 July 2007, transposes the European Directive 2002/58/EC into national legislation. It governs the protection of personal data in the field of telecommunications and electronic communications and takes recent and foreseeable developments in the field of services and technologies involving electronic communications into account. The Act of 2005 was also amended by the Act of 24 July 2010, which is a transposition of Directive 2006/24/EC of 15 March 2006. In addition, the Act of 28 July 2011 transposes several provisions of Directive 2009/136/EC of 25 November 2009.
